Sebastian's Farewell Boat Party!

IMPORTANT SAFETY NOTICE

No minor may board or participate in swimming, vessel jumping, cliff jumping, or any water-based activity unless this form has been completed and signed by a parent or legal guardian.

Cliff jumping is not guaranteed. Cliff jumping is entirely at the captain’s discretion and will only happen if the captain and crew decide that the location, weather, sea conditions, supervision, guest behaviour, and overall safety are acceptable.

I am the parent or legal guardian of the minor named above. I give permission for my child to attend and participate in Sebastian’s Farewell Party aboard the vessel operated by ÜberVida Ltd.

I understand that this is a boating and water-based event and may include boarding and disembarking the vessel, moving around the vessel, swimming, jumping into the water from the vessel, snorkeling or other water activities, and, only if approved by the captain and crew, cliff jumping.

1. Assumption of Risk

I understand that boating, swimming, cliff jumping, jumping from the vessel, snorkeling, and other water activities involve risks. These risks include, but are not limited to, slips, falls, cuts, bruises, broken bones, head, neck or back injuries, drowning, panic in the water, contact with rocks, reefs, marine life, other swimmers, boats, changing weather, waves, currents, and other hazards.

I understand that these risks can result in serious injury or death. I voluntarily allow my child to participate and accept these risks on my child’s behalf.

2. Swimming Ability

I confirm that my child:

Can swim confidently in open water;
Is comfortable entering and exiting the water from a boat;
Is comfortable being in the ocean;
Will follow all instructions from the captain and crew.

If my child is not a confident swimmer, I understand that I must inform ÜberVida Ltd. before the event.

3. Cliff Jumping Permission

I understand that cliff jumping is not guaranteed and is only permitted if the captain and crew decide that it is safe on the day.

I understand and agree that:

The captain and crew may prohibit cliff jumping entirely;
The captain and crew may choose the location, height, and method of entry into the water;
My child must only jump from areas approved by the captain and crew;
My child must not climb, jump, dive, push others, or enter the water unless instructed to do so;
My child must jump feet-first only unless expressly permitted by the captain or crew;
My child must wait for the crew’s signal before jumping;
My child must immediately move away from the landing area after entering the water;
My child may be refused participation if the crew believes it is unsafe for any reason.

I understand that cliff jumping carries a higher risk of injury than normal swimming or boating activities.

4. Captain and Crew Authority

I understand that the captain has full authority over the vessel, guests, route, timing, water activities, and safety decisions.

I agree that my child must follow all directions from the captain and crew. I understand that ÜberVida Ltd. may stop my child from participating in any activity if my child does not follow instructions or if the captain or crew believes it is unsafe.

5. Behaviour and Safety

I agree that my child must behave responsibly and respectfully during the event.

My child will not:

Push, trip, wrestle, or throw anyone into the water;
Run on the vessel;
Jump without permission;
Dive into unknown water;
Climb cliffs or rocks without permission;
Ignore crew instructions;
Bring or consume alcohol, drugs, vapes, or illegal substances.

6. Medical Conditions

I confirm that my child is physically able to participate in boating and water activities.

I will advise ÜberVida Ltd. before the event if my child has any medical condition, allergy, injury, medication requirement, panic/anxiety in water, asthma, seizure condition, heart condition, or any other issue that may affect participation.

7. Life Jackets and Safety Equipment

I understand that the captain and crew may require my child to wear a life jacket or other safety equipment at any time. I agree that my child must wear any required safety equipment when instructed.

8. Medical Assistance

In the event of an emergency, I authorize ÜberVida Ltd., the captain, crew, event organizers, or hosts to seek medical assistance for my child if necessary. I understand that I remain responsible for any medical costs or related expenses.

9. Personal Belongings

I understand that ÜberVida Ltd., the captain, crew, organizers, and hosts are not responsible for lost, stolen, wet, or damaged personal items, including phones, watches, bags, clothing, shoes, and electronics.

10. Photos and Videos

I understand that photos and videos may be taken during the event. I consent to reasonable use of photos and videos from the event for private memories and/or promotional purposes, unless I notify ÜberVida Ltd. in writing before the event.

11. Release of Liability

To the fullest extent permitted by law, I release and hold harmless ÜberVida Ltd., its owners, directors, employees, captain, crew, agents, representatives, event organizers, hosts, and invited guests from any claims, losses, injuries, damages, costs, or expenses arising from my child’s participation in this event, including boating, swimming, cliff jumping, jumping from the vessel, snorkeling, and other water activities, except where caused by gross negligence or willful misconduct.

 

12. Parent/Guardian Confirmation

I have read and understood this waiver. I understand the risks involved, including the increased risks associated with cliff jumping. I confirm that I am the parent or legal guardian of the minor named above and that I have authority to sign this waiver.
